Mr Al-Tuhamy has been charged with three counts of war crimes and four counts of crimes against humanity, namely imprisonment, torture, cruel treatment and outrages upon personal dignity, amongst others. On 26 February 2011, the United Nations Security Council (UNSC) referred the situation to the International Criminal Court (ICC), which conducted a preliminary examination. On 3 March 2011, an investigation was opened.
Al-Tuhamy Mohamed Khaled (“Mr. Al-Tuhamy”), who is wanted for war crimes and crimes against humanity committed in Libya, remains at large.

Middle East - North AfricaAl-Tuhamy Mohamed Khaled (“Mr. Al-Tuhamy”), alleged former Lieutenant General of the Libyan army and former head of the Libyan Internal Security Agency (ISA), is wanted for war crimes and crimes against humanity committed in Libya in the context of widespread and systematic attack against the civilian population from 15 February to 24 August 2011. The arrest warrant for Mr. Al-Tuhamy was issued under seal on 18 April 2013 and was unsealed by the Pre-Trial Chamber I of the ICC on 24 April 2017. According to Prosecutor Bensouda, the arrest warrant was reclassified as public with hope to facilitate the arrest and surrender of Mr. Al-Tuhamy “as all states will be aware of its existence” and “could foster support and cooperation for an arrest operation from the international community.”
