Paraguay signed the Rome Statute on October 7, 1998 and ratified it on May 14, 2001, becoming the 3st State Party. It also signed the APIC on February 2004 and ratified it on July 19, 2005. However, it publicly rejected the BAI. As State Party to the MERCOSUR, it signed the Joint Declaraion on June 20, 2005 adopted in Asuncion. On July 1, 2003 the Department of State declared that Paraguay is not qualified to receive military assistance.

The Ministry of Foreign Affairs prepared a draft law on the ICC that includes provisions on cooperation and complementarity. Such project was presented to the Legislative Committee and the Constitutional Affairs Committee in 2013. O October 1, 2014 the Consitutional Affairs Commitee of the Senate of Paraguay approved the draft law, that should be send to the Parliament Plenary for its approval once its approved by the Legislative Committee.

During 2015, the lack of quorum for the inclusion of the project in the agenda of the Legislative Committe, has prevented its discussion.
